    Terms of Service

    1. Agreement to Terms

    By accessing or using PushTen ("we," "our," or "us") at pushten.com and any related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

    2. Products & Services

    PushTen offers digital website and application templates ("Templates"), a bundled template collection known as "The Vault," and custom design and development services ("Custom Build"). All products are delivered digitally.

    3. Purchases & Payments

    All purchases are processed securely through Stripe. By completing a purchase, you agree to pay the listed price at the time of checkout. Prices are listed in USD and are subject to change without notice. Promotional codes, when valid, will be applied at checkout and are subject to their specific terms and expiration dates.

    4. License & Usage Rights

    Individual Template Purchase: Each individual template purchase grants you a single-use, non-exclusive, perpetual license to use the template for one (1) project. You may modify the template for your own use or a single client project.

    The Vault (Annual or Monthly Access): A Vault subscription grants you a non-exclusive license to use all current and future templates for unlimited projects, including client work and commercial deployments, for the duration of your active subscription. You receive full commercial and whitelabel rights, meaning you may rebrand and deploy templates under your own brand or your clients' brands without attribution. Access to new templates requires an active subscription. You may cancel anytime.

    You may NOT:

    • Resell, redistribute, or sublicense the templates themselves (as templates)
    • Share your account access or template files with third parties
    • Claim ownership of the original template design or code
    • Use templates for any unlawful purpose

    5. Refund Policy

    Individual templates: A 14-day refund window applies if the template has not yet been deployed. To request a refund, email hello@pushten.com within 14 days of purchase and confirm the template has not been deployed to any live domain or client project.

    The Vault (subscription): You may cancel your subscription anytime and access will end at the close of the current billing period. Payments already made are non-refundable once Vault access has been delivered. Cancelling stops future billing, it does not refund past charges.

    If you experience a technical issue that prevents you from accessing your purchase, please contact us at hello@pushten.com and we will work to resolve it promptly.

    6. Custom Build Services

    Custom Build projects are scoped individually and governed by a separate project agreement provided before work begins. Pricing starts at $3,500 and varies based on project scope. Timelines, deliverables, revision rounds, and payment schedules will be outlined in the project agreement.

    7. Intellectual Property

    All template designs, code, copy, branding, and other materials created by PushTen are the intellectual property of PushTen until a valid license is granted through purchase. Upon purchase, you receive the usage rights described in Section 4 above, not ownership of the underlying intellectual property.

    8. Account & Access

    Template access is delivered via email after purchase. You are responsible for maintaining the security of your email and any accounts associated with your purchase. We are not responsible for unauthorized access resulting from your failure to safeguard your credentials.

    9. Disclaimer, Limitation of Liability & Indemnification

    As-is basis. PushTen templates, The Vault, and all related materials are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uptime, error-free operation, security, or that any template will produce any specific business, revenue, legal, or regulatory outcome. You are solely responsible for evaluating whether a template is suitable for your intended use.

    Your responsibility as operator. You alone are responsible for anything you build, deploy, sell, resell, whitelabel, or operate using a PushTen template, including but not limited to: hosting and infrastructure choices, third-party services and API keys, custom code you add, payment collection, tax collection and remittance, data protection, privacy and security compliance (including GDPR, CCPA, HIPAA, PCI-DSS, and any similar law), consumer protection compliance, advertising and marketing claims, refund and support obligations to your end users, and the accuracy of any content you publish. PushTen is not a party to any relationship between you and your customers or end users.

    Limitation of liability. To the maximum extent permitted by law, PushTen, its founder, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, goodwill, data, customers, opportunities, or business interruption, arising out of or related to the templates, The Vault, or your use of any PushTen product, even if advised of the possibility of such damages. Our total aggregate liability to you for all claims arising out of or relating to the templates or these Terms shall not exceed the greater of (a) the amount you actually paid PushTen for the specific product giving rise to the claim in the twelve (12) months preceding the event, or (b) one hundred US dollars ($100).

    Indemnification and hold harmless. You agree to defend, indemnify, and hold harmless PushTen, its founder Brian Hanson, and its employees, contractors, and affiliates (the "Indemnified Parties") from and against any and all claims, demands, actions, investigations, liabilities, damages, losses, judgments, settlements, penalties, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use, deployment, resale, whitelabel, distribution, or operation of any template or application built with a template; (ii) any product, service, business, or content you offer using a template; (iii) any dispute between you and any of your customers, end users, employees, contractors, investors, partners, or regulators; (iv) any claim that your use of a template infringes, misappropriates, or violates any third party's intellectual property, privacy, publicity, or contractual rights; (v) any violation by you of these Terms, any applicable law or regulation, or any third-party terms of service (including those of Lovable, Stripe, Supabase, hosting providers, and API providers you connect); (vi) any data you collect, process, store, or transmit through a template; and (vii) any tax obligation you incur or fail to satisfy. This obligation survives termination of your license or Vault subscription.

    No professional advice. PushTen does not provide legal, tax, accounting, financial, medical, or other professional advice. Nothing in a template, in our marketing, or in our communications should be construed as such advice. You are responsible for engaging your own qualified professionals as needed.

    10. Modifications to Terms

    We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised terms.
